請教PJIANG老師,關於O-1申請,一個律師的回答

先把BACKGROUND再陳述一遍:

我老婆2005年申請了NIW, 140批準,我們的485 PENDING (我是dependent),我有EAD但是一直沒用(2009.1-2010.1).
我的H1將在兩個月內到六年的期了....因為我是老婆NIW申請的dependent,所以不能享受H1六年後延期的規定.

我已經申請了一個O-1,PENDING....

如果這個O-1在我的H1失效後才批準,在GAP期間我用了EAD,那麽O-1批準後我可以直接用O-1嗎?

You are asking a question that is in the grey area of the law. Technically, your O-1 petition were filed when you were in valid H-1B status. Working on the EAD in the mean time, may complicate this and could make you ineligible for a change of status. Therefore, if you wish to avoid possible complications, I recommend applying for premium processing at this time.
