opt tax Q

Hi,
I thought some people in this forum might have some similar experience(in US), please help.
My husband was holding opt and working at university from 09/2005-10/2006.During that period and until now, he did not pay any FICA tax(Medicare+social Security),is it leagally? Does anyone has any information about it? thank you for your help
