本劇的故事跨度從1939年冬到1949年秋，展現了中國共產黨領導的人民司法製度早期誕生、發展的曆史縮影，是為紀念中華人民共和國成立六十年大慶和最高人民法院成立六十周年而創作拍攝的。

本劇主人公的原型叫馬錫五，曾任陝甘寧邊區政府專員、陝甘寧邊區高等法院隴東分庭庭長，新中國建立之初，擔任最高人民法院副院長。他在擔任庭長期間，改變舊衙門官老爺式的審判作風，走群眾路線、以調解為主，受到人民群眾的愛戴和擁護，老百姓親切的稱他為“馬青天”，他方便群眾訴訟的審判方式，被稱為“馬錫五審判方式”。毛主席在延安親筆給他題字“一刻也不要脫離群眾”。馬錫五的審判方式被西方人稱為“東方審判經驗”，對創建新中國司法製度產生過深遠的影響，今天在以胡錦濤總書記為代表的黨中央提出的執法為民、創建和諧社會中同樣具有現實意義。

這是一部為新中國老一輩司法工作者樹碑立傳，向農民兄弟姐妹鞠躬致敬的作品。片中大部分角色，都是請當地農民來飾演，片中的陝北民歌和片尾曲，都是由當地農民歌手演唱的，原汁原味，體現出本劇的一種獨特的風格。
