為了解除就【惜別】紀實散文中的某些疑惑， 我將 ”同心協力，不要讓華人渣滓侵占我們的生意家產！“此文再次公諸於眾：

諸位朋友：這是一個發生在我家的真實而不幸的故事，望諸位通過我的不幸，令其不在你自己和您的親朋好友之間重演。並期望通過我的不幸，令我們一改各掃自家門前雪，那管他人瓦前霜的局麵。以下是本人二月28日在魁省高級法庭有關我和罪犯鬥爭，不幸成為罪惡和官僚製度犧牲品長達八年，終於真相大白的陳述。同時希望借此盡快將罪犯無牌意大利女律師ENZA MARTUCCELI 和華人渣滓何卿銳繩之以法，一確保他人不再受之其害。

SAWATDEE 餐館詐騙案的陳述

受害者：潘振國(PETER)，
泰國餐館SAWATDEE業主(位於457ST-PIERRE蒙特利爾老城，現被詐騙犯非法侵占關閉)。因幫助警方將詐騙慣犯繩之以法而傾家蕩產，重病纏身，無辜成為犯罪和官僚法律製度的犧牲品而無法自拔。

詐騙犯一：
ENZA MARTUCELLI，意大利人，無牌律師並自1991年有犯罪記錄。 1995年十一月三十日受害者妻子任翠琴由YWCA外派做義工不幸殉職(1995年十二月八日在蒙特利爾普濟醫院逝世)。1995十二月二日ENZA受YWCA指派為受害者提供法律和家庭援助(事實上，法庭當時罰其為社區義工，想不到YWCA竟然讓其為公眾提供法律服務)。由此借機有計劃地采用各種手法詐騙受害者。於1998年在逃至今。1999年判刑，現有法庭和警方通緝令。

詐騙犯二：
何卿銳(QINGRUI HE)，由TORONTO脫離大陸政府經濟考察團於1994年在唐人街萬寶樓素餐館非法打工與受害者遺妻相識並向受害者遺妻借$5，000美金申請移民 (迄今尚未歸還)。由於其複雜的政治背景無法令其家屬獲得大陸護照，因其聲稱無人願意出麵幫其解難，受害者於1996年初出麵令其妻子和女兒獲得大陸護照 (其妻和女兒已於1996年9月抵加)。受害者同情其處境，讓其在等簽證期間在SAWATDEE打工。

受害者萬萬沒有料到何卿銳是如此卑鄙肮髒的小人，乘受害者之危，竟和詐騙犯ENZA一起串謀為其洗刷罪證，毛遂自薦地為受害者管理飯店業務，非法以受害者飯店的同名在受害者相同地點注冊個人公司從中偷竊營業額$35，000。受害者發現後，要求他離開飯店並不追求贓款和責任，何卿銳竟然拒絕受害者的條件， 強占飯店遭警方起訴。

然而由於刑事訴訟程序的緩慢，更由於罪犯ENZA精通律法，深曉官僚製度的漏洞；而何卿銳前身是中國政府特種間諜(據其自稱他是由中國政府從全國各地軍隊內精心篩選的11名最優秀的特工經專門培訓後負責偵探收集蘇聯情報)，大大增加了警方偵查的難度。

為了逃避警方的起訴，ENZA和何卿銳竟然在毫無證據的情況下編造假案(500-05-2818-970 — the case never continued up to today)，詭稱他們與受害者三者共享受害者公司的股份，向魁省高級法院提出訴訟：要求受害者歸還本屬他們的股份並追加$400，000 的賠償。由於法製的官僚，罪犯們竟然意想不到地順利地封殺了受害者個人，公司和飯店的所有財產包括RRSP！

而後罪犯們通知受害者的律師STEPHEN ANGERS，並令其在剛剛拿了受害者$3，000 定金和價值$10，000 的絲綢服裝後，根本沒有采取任何法律途徑保護受害者，連罪犯們非法經營受害者生意亦不向法庭投訴，詭稱因擔心受害者今後無力支付訖費用而離去。

接著何卿銳通過其在SUBUBBAN報社工作的好友何某竟以$800望從受害者手中買斷SAWATDEE， 遭拒後又通過其律師ADAMS FREDY以$30，000望從受害者手中買斷，又遭受害者拒絕。

1999年罪犯ENZA在逃後，何卿銳於2000年四月由其律師ADAMS FREDY出麵，避其向受害者追討股份和賠款一案自1997年後從不繼續訴訟的現實，另立一案 (500-02-084866-008)，在不通知受害者的前提下，要求法庭將其非法強占三年之久受 害者的產業及經營權SAWATDEE判歸他的名下。此案於2000年八月由何卿銳自己撤訟。

何卿銳撤訟的原因是其竟然頂著受害者公司的名義非法地侵吞了受害者房東付給受害者遷出SAWATDEE 的賠款 (500-02-075939-996)，更有甚之，何卿銳趁次之際完全侵吞了受害者SAWATDEE的全部產業，逃之夭夭。

其實事情按理絕對不會糟到如此令人心寒的地步如果律師多講究一些職業道德的話。尤其是受害者的現任律師BERNARD PAGER拿了受害者的錢，卻和何卿銳同沉一氣，甚至不顧受害者的請求，不但不起訴，連他的名字也從未在原有的案例注冊，給罪犯足夠的時間藏匿，轉移所有 的贓款髒物後，要求受害者與罪犯們簽署放棄訴訟權益，遭拒後隱身不現至今。

經受害者的一再努力，2003年2月28日魁省高級法庭終於同意受害者出庭為自己辯護。受害者帶著所有的證據，以事實向法官陳述8年的不白之冤，8年的冤屈，8年的折磨，終於有了真相大白，還其本來麵目的一天。

作為一個受害者和官僚製度的犧牲品，本人潘振國絕對為以上的陳述負法律責任。如詐騙犯ENZA MARTUCELLI，何卿銳認為以上不實，可以出庭和我辯論。本人以下定決心，一定會通過廣大華人朋友協力，將其繩之以法，決不再讓其遺禍他人，繼續逍 遙法外，侵吞華人艱苦奮鬥創業的血汗錢。

同時希望大家通過我的不幸，接受一個沉痛的教訓，千萬不要由於好心助人而因擇人不慎而毀滅自身。謝謝大家。

Let Us Stand Together—Don’t Let Criminal Elements Tarnish and Steal from Our Community

Dear Friends,

This is a true and tragic story that happened to me and my family. I hope that by sharing my suffering, you and your loved ones can avoid experiencing similar injustice. I also hope that this painful experience can awaken us as a community, moving us beyond the mentality of “sweeping only the snow from our own doorstep” and ignoring the frost on our neighbor’s roof.

Below is my February 28 statement to the Quebec Superior Court — a declaration after eight years of being a victim of both criminal fraud and bureaucratic injustice. The truth has finally come to light, but not without immense personal cost. I now seek the community’s support to bring the criminals to justice: the unlicensed Italian lawyer Enza Martuccelli and the Chinese collaborator Qingrui He, so others are not harmed by them.

Statement on the Sawatdee Restaurant Fraud Case

Victim: Peter Zhen Guo Pan
Business: Owner of Sawatdee Thai Restaurant, located at 457 St-Pierre, Old Montreal.
Current Status: Business illegally taken and shut down by fraudsters. Victim financially ruined, gravely ill, and a casualty of crime and bureaucratic neglect.

Criminal #1: Enza Martuccelli

• Italian national, unlicensed lawyer, with a criminal record since 1991.

• In November 1995, after my wife Cuiqin Ren tragically passed away while volunteering through YWCA (she died in Montréal’s Hôtel-Dieu Hospital on December 8, 1995), Enza was assigned by YWCA to provide legal and family assistance to me (as court-ordered community service).

• She exploited this opportunity to defraud me through deceitful and calculated legal manipulation.

• She fled in 1998. A warrant for her arrest was issued in 1999, and she is still at large.

Criminal #2: Qingrui He

• Originally from China, illegally employed at a vegetarian restaurant in Montreal's Chinatown after leaving a Chinese economic delegation in 1994.

• Became acquainted with my late wife, borrowed US $5,000 to apply for immigration (still unpaid).

• Due to political complications, he could not obtain passports for his family. Out of compassion, I helped him obtain travel documents for his wife and daughter, who arrived in Canada in September 1996.

• While awaiting immigration, I allowed him to work at Sawatdee.

I never imagined that this man, whom I helped out of kindness, would betray me so completely. Working in collusion with Enza Martuccelli, he began “managing” my restaurant while secretly registering a company under the same name, at the same location, and illegally diverted $35,000 in business revenue.

After discovering this, I asked him to leave and offered not to press charges if he returned the money. He refused, continued occupying the restaurant, and was charged by police.

Escalating Legal Manipulation

Due to delays in the criminal justice process and Enza’s legal knowledge of how to exploit the system, they filed a false civil claim in Quebec Superior Court (Case No. 500-05-2818-970) asserting that they shared ownership of the restaurant and demanding $400,000 in damages.

Shockingly, the court froze all my personal, company, and restaurant assets — including my RRSP — based on this baseless claim.

They then contacted my lawyer, Stephen Angers, who had just accepted $3,000 from me and received $10,000 worth of silk garments. Without taking any action to defend me or challenge the illegal operation of my business, he abandoned the case, claiming I could no longer pay.

Continued Attempts to Steal My Business

Qingrui He, through contacts at Suburban newspaper, attempted to buy Sawatdee for $800. I refused. He later offered $30,000 through lawyer Adams Fredy — also refused.

In 2000, after Enza fled, Qingrui He filed a new case (500-02-084866-008) to claim full ownership of Sawatdee — without notifying me. He withdrew the case in August 2000, as he had already fraudulently collected the compensation that my landlord had paid me to vacate the restaurant (Case No. 500-02-075939-996), and fully seized the business assets before disappearing.

Failure of Legal Representation

My new lawyer, Bernard Pager, took my money and also failed to act in my interest. He did not register his name on my case file, allowing the criminals time to hide assets and escape. He even tried to force me to sign away my legal claims in a settlement agreement — which I refused. He then disappeared.

Finally, a Day in Court

After countless efforts, I was finally allowed to represent myself in Quebec Superior Court on February 28, 2003. I presented all the evidence and detailed my eight years of suffering, injustice, and persecution. The truth was finally recognized in court.

Final Statement

As a victim of both criminal fraud and institutional neglect, I, Peter Zhen Guo Pan, take full legal responsibility for the above statement. If Enza Martuccelli or Qingrui He believe any of this is untrue, they are welcome to confront me in court.

I am determined to pursue justice with the help of fellow Chinese Canadians and the broader community. These individuals must be held accountable so that no more hardworking Chinese families fall prey to such evil.

Let my painful experience be a hard lesson to us all: kindness must be given carefully, and blind trust can destroy lives.
