親屬移民綠卡的基本種類和申請步驟 ZT

親屬移民綠卡是指通過某些家庭關係申請綠卡，美國公民或綠卡持有人叫做申請人，等待獲得綠卡的人叫做受益人。親屬移民可以分為兩大類別。第一種類別可以稱作超級優先，沒有名額限製，包括三種情況：1. 美國公民的配偶；2. 美國公民的父母（不包括嶽父母）； 3. 美國公民的未成年未婚子女（21歲以下）。

    第二種類別分為四大類，俗稱四類優先（preference），每年大約一共有226，000個名額。第一優先大約有23，400個名額，是指美國公民的成年未婚子女（21歲以上）；第二優先大約有114，200個名額，分為兩小類：1. 美國綠卡持有人的配偶及未成年未婚子女（21歲以下）； 2. 美國綠卡持有人的成年未婚子女（21歲以上）。第三優先大約有23，400個名額，是指美國公民的成年已婚子女（21歲以上）；第四優先大約有65，000個名額，是指美國公民的兄弟姐妹。

    顯而易見，有幾種情況是不能申請親屬移民的。比如，綠卡持有人不能為父母申請綠卡，必須在綠卡轉為美國公民後，才能為父母申請綠卡。叔叔、伯伯、姑姑、姨媽、侄子、侄女、堂表兄妹等關係不能申請親屬移民。

    親屬移民的申請步驟視優先的不同及受益人是否在美國而有所不同。如果受益人身在美國，超級優先的親屬移民可以直接在當地移民局申請（I-130），受益人也可以同時遞交轉換綠卡身份（I-485）的申請，而其它優先的親屬移民必須先向本地所屬的移民中心遞交移民申請，等到排期以後，受益人才能向當地移民局遞交轉換綠卡身份的申請。如果受益人身在國外，所有的親屬移民必須先向移民中心遞交移民申請，其中，美國公民還可以同時為配偶及未成年未婚子女申請K-3/K-4簽證先進入美國，然後在美國境內遞交轉換綠卡身份的申請。而其他的移民申請在被批準後，案子會自動轉到美國國務院下屬的國家簽證中心，進而轉到相應的美領館，完成移民簽證的手續。另外，美國公民還可以申請未婚妻/夫簽證，來美國後成婚並申請綠卡。

    有趣的是，各類優先並不是一成不變的。在漫長的申請過程中，如果美國公民的成年未婚子女結婚成家了，這個申請就會從第一優先變成第三優先，等待綠卡的時間就會更加漫長。但是，如果綠卡持有人加入了美國國籍，第二優先的申請就會一躍升為超級優先或者第一優先，等待綠卡的時間就會顯著縮短。

FB-4 is an immigration visa in INA 203(a)(4). The beneficiary of an approved immigration visa petition is entitled to obtain permanent residence (green card) of the United States. FB-4 is for persons who are brothers and sisters of US citizen.

Who are "Brothers and Sisters" of US citizen under Immigration Law?
• "Brothers and sisters" are those meet the definition of being a child from one or both parents.

• Half-siblings are considered "brothers and sisters" and can petiton for permanent residence for one another.

• Adopted brothers or sisters are considered "brothers and sisters" and can petition for permanent residence for one another if the adoption relationship was formed before they were 16 years old.

• Step brothers or sisters are considered "brothers and sisters" and can petition for permanent residence for one another if the step relationship was formed before they were 18 years old.

• Siblings who have been adopted by another family in accordance with INA section 101(b)(1)(E) is not considered "brothers and sisters" for immigration purpose and so cannot petition for their natural siblings.

親屬移民的名額是 226,000，中國大陸出生的申請者也存在排期的問題。
親屬移民的類別是這樣來劃分的：
FB-1 公民之未婚子女 (Sons and Daughters)（名額是 23,400）
FB-2a 綠卡的配偶、不足 21 歲之未婚子女（名額是 114,200 x 77%）
FB-2b 綠卡的 21 歲以上未婚子女（名額是 114,200 x 23%）
FB-3 公民之已婚子女（名額是 23,400）
FB-4 成年公民（21 歲以上）之兄弟姊妹（名額是 65,000）
同樣，上一類別未能使用完的名額可以轉入下一類別在同年度內使用。
