In contrast to the steady forward progression seen in recent months, this Bulletin shows no forward movement for the first preference Employment Based category or for the second preference Employment Based category. Please see below for further discussion. Please review this chart to see if your priority date is current. Remember that if you are a Labor Certification beneficiary, your priority date is determined by the date on which your employer filed your Labor Certification. If you skipped the Labor Certification stage, then your priority date is the date on which you filed your I-140. If your priority date is current and you have not yet filed your I-485 Application to Adjust Status, you should prepare your materials now for filing on the first business day of next month. Employ- ment Based All Charge-ability Areas Except Those Listed CHINA INDIA MEXICO PHILIP-PINES 1st C C 01JAN06 C C 2nd C 01MAR05 U C C 3rd 01OCT01 01OCT01 01APR01 22APR01 01OCT01 Schedule A Workers C C C C C Other Workers U U U U U 4th C C C C C Certain Religious Workers C C C C C 5th C C C C C Targeted Employment Areas/ Regional Centers C C C C C EB2 Unavailable for Indian Applicants Indeed, the biggest change in this month’s bulletin is the fact that for second preference Employment Based category applicants from India, the date is currently listed “Unavailable.” In essence, this means that as of August 1, the visa numbers in this category will become unavailable. Applicants in this category will not be able to file their I-485 Applications to Adjust Status nor proceed with consular processing regardless of their priority date as of August 1 until the numbers become available again. After the beginning of the next fiscal year, which is October 1, it is likely that these numbers will be re-issued. Please note that applicants in this category remain eligible to file Labor Certifications and I-140 Immigrant Visa Petitions at this time – they are simply not eligible to file I-485 Applications to Adjust Status. Further Retrogression Predicted The Department of State notes that next month’s bulletin will likely show additional retrogression of cut-off dates in the following categories: Worldwide EB4, China EB2 and EB3, India EB1, and Mexico EB3. That means that the dates in these categories will likely move back. If you are currently eligible to file your I-485 Application to Adjust Status, you would be wise to do so before the end of August so as to avoid additional retrogression. We hope to see these dates move forward again after October 1, which is the beginning of the next fiscal year. Schedule A Numbers Dwindling The 50,000 visa numbers allocated for Schedule A cases are close to being exhausted.
