When you apply GC for your child, I do not even see any where ask you have the custody. Check the link I posted above and you may also ask your local USCIS officer.

When I applied GC for my son, they did not ask the custody. But they did ask me why I did not apply GC for my son when I applied mine. I then use custody as a good reason.
