section 1256 option tax for SPY

this year seems rule changed for SPY options, it is treated as section 1256 (Etrade). I confirmed with Etrade. I can't find the same information when Google it, SPY still not on the section 1256 list. Does anybody from other brockage have the same treatment for SPY option this year (2023)?
