8老師，收到approval notice了，但是還有疑問。。

一周前收到email notice，新的H1B貌似被批了，但是現在還沒收到正式書麵的approval notice...這個過程大概要多久？

anyway。。現在在準備回國簽證（因為律師申請的是走consular processing），在填DS160表碰到下麵這個棘手的問題：


Have you ever been unlawfully present, overstayed the amount of time granted
by an immigration official or otherwise violated the terms of a U.S. visa? 

我知道自己從10月1日到現在一直處於out of status狀態。但是否算unlawfully present? 如果算，就要回答YES，然後解釋。到底如何解釋為好？回答YES會不會對我的簽證產生很大的負麵影響？
