We went there for vacation, and on the way back, we were stopped by custom, asking for visa. We did not bring H1 with us, and explained to them, they found our records and let us come back.

Now the question is, does that count to clear up out of status record before leaving for US Virgin Islands?
-No. You need to get an H1/H4 visa outside U.S. to come back to clear the record. Even if you go to Canada/Mexico and come back within 30 days (not need visa), you still can not clear the record. So, if your unlawful presence was less than 180 days, you may go to Canada/Mexico to get an H1 visa to come back even if you were out of status > 180 days.
