我現在的雇主幾個月前開始給我辦理綠卡，可進展緩慢，PREM還沒有交。但是我的H1B 過三個月就到期了。現在有一個雇主願意雇用我，並且幫助辦簽證和身份。因為我的綠卡排期已經是current （以前的雇主給辦過、I－140批準、當時排期未到，於是後來換工作一直H1B transfer 給三年extension），我不知道這種情況下能否申請H1B transfer、並且得到一年延期。

-Yes, you can ask the employer to do the H-1 transfer for you and request another 3-year term using your old I-140 Approval Notice (provide the photocopy of the I-140 Approval Notice to your new employer).

如果我一切指望現在的雇主，就隻能希望PREM 快些申請通過，把I－140/I－485/EAD申請同時交上去。謝謝！

-You had better ask the new employer to file I-140 and ask USCIS to do I-140 prority date portability to your new I-140 at the same time. May use premium processing to get the I-140 approved in 15 days. Then, file I-485.

If you file I-485 and I-140 concurrently, USCIS may not accept it though technically you can do that. I have seen several cases like that and USCIS rejeceted them. Talk to your lawyer.
