我妹妹現在是H1B，他的男朋友現在是OPT, 如何他們現在結婚

明年他男朋友回中國以OPT簽證，會不會因為跟H1B結婚有移民傾向而被拒

-No. Irrelevant.

另外結婚後，如果不file I539的話，配偶的F1 OPT身份還是有效的吧，不會自動轉成H4, 導致OPT invalid或不能延期吧？

-No. Only if she files I-539 to change status and get the new status approved or F-1 status expires, then her F-1 status can be void.
