如題所問。I-485 在2015年7月提交,至今已經一年(>180天),EB2/3 排期退後,所以隻能等到今年10月再看什麽時候才能再回到current。新的公司本周下offer,新職位與當前幾乎完全一致 (我和HR都這樣認為)。根據以前同事的經驗,原以為辦理work authorization很容易, 拿有效的EAD/AP card,並‘supplement the form I-485 record of proceeding with documentation relating to the new job offer that forms the basis of the INA 204(j) portability request’。

現在新公司的律師要求提供I-140 petition document 或者certified PERM 來判定是否可以將當前的green card application轉到新公司。通過與當前雇主有關部門的談判(當然沒有說為什麽要這些材料,隻能說為了personal issue),得到的結論是這些材料歸公司所有,不能分享給雇員,很堅決。

我將手頭上所有的材料都給了新公司的移民律師,包括H-1B的申請材料(job description/title/duty), I-140 approval, I-485 receipt, EAD/AP card, emplyment verificaiton letter from HR, 等等。但是他們說不夠。

請問各位老師,我這種情況應該如何處理。非常感謝大家的幫助。

-Your pending I-485 and the PERM/I-140 sponsored by the old employer have nothing to do with the new employer, and thus you don't need to provide any documents about it to the new employer. Of course, if you want to do  H-1 transfer beyond the 6 year limit, you may proivde the copy of the I-140 approval notice and the copy of your old H-1 appoval notice with the I-94. Otherwise, you may justfile I-765 to apply for EAD by yourself by providing the copy of I-485 receipt (no I-765 filing fee).

If USCIS send you RFE later for your employment status, you just ask the new employer to give you the employment verification letter. Of course, you can choose to inform USCIS that you have changed job in the same field now in writing and enclose the copy of the now job offer letter and the copy of I-485 receipt. Thus, USCIS will not send you RFE later.  That is all!
