車禍，要上法庭，緊急求助

A relative of mine was injured in a car accident while visiting me in California in 2011 and she is not in US right now. Because my attorney dragged the negotiation with the insurance too long and withdrawn from this case at the end, we have only ONE week left to file a case in court to protect the status of limitation.

My question: can I file a case in court on her behelf? I have her power of attorney but I am not a lawyer.
