a. 政府監視是否違法違憲要看監視的內容及用於什麽目的。 是為了國家安全國家利益,還是為了打壓持不同政見者反對黨或政敵。 為了國家安全國家利益的監視則不違反憲法; 在中國,政府在網上監視打壓刪除或封鎖持不同政見者的言論的做法就是違憲,因為言論自由是憲法賦予我國公民的權利。 到目前為之,還沒聽說美國政府在網絡監視共和黨的活動。
b. 盡管網絡監視是為了國家的安全和利益而不是為了打壓持不同政見者反對黨或政敵,但也有可能不必要的使監視範圍太大而侵犯了公民的隱私權。 其實,這倒是美國人民現在最關心的,而且OBAMA也在采取各種措施糾正這些問題。 在這裏,實際上已是一個國家安全與個人隱私之間的如何平衡的問題。 有人說安全重於個人隱私,有人說更在意個人隱私。 怎麽辦? 最後隻有國會根據民意投票表決一個法案。 實際上,機場的安檢也屬同類事情。
c. 其實,SNOWDEN 事件後,OBAMA已經提名了一個知名的"公民自由隱私"維權人士參與政府的網絡監視機構作為WATCHDOG。 實際上,國會也在對此調查聽證。
所以說,不用為人家操心。美國的司法是獨立的,憲法不是一張廢紙。
