No liability for emergency aid unless gross negligence
1 A person who renders emergency medical services or aid to an ill, injured or unconscious person, at the immediate scene of an accident or emergency that has caused the illness, injury or unconsciousness, is not liable for damages for injury to or death of that person caused by the person's act or omission in rendering the medical services or aid unless that person is grossly negligent.
British Columbia's Good Samaritan Act offers relatively broad protection: Protects individuals who provide emergency medical assistance at the immediate scene of an accident or emergency. No liability for damages caused by acts or omissions while providing assistance unless there was gross negligence.

我知道在加拿大必須是有first aid certificate才可以動手救人。以前我同一個加拿大朋友打獵的時候,在1號公路遇到一起車禍,我是醫生,但我的加拿大朋友有first aid certificate,他不讓我動手,怕我吃官司,他可以動手,因為他有證書,但是他不知道怎麽救人。所以,是我在旁邊指揮,教他怎麽做,他動手救人的。

看到英文報道,醫生的先生告訴記者, 被救男孩的母親問他們要電話,希望感謝。 他們按照中國人的傳統,拒絕了 (即中國人助人為樂,不圖回報的傳統)。
“She was scared, so scared,” Andy said. “Then she showed her thanks to us—she wanted us to leave our numbers for her. But according to the tradition of the Chinese people, you know, we refused that. We just do what we need to do.”
For Andy and Rui, the experience reinforced two things: the importance of learning basic life-saving skills like the Heimlich manoeuvre, and the challenge of getting internationally trained doctors certified to work in Canada.
Although Rui spent more than a decade working as a doctor in China, she is currently not allowed to practise in Canada.
One of the biggest barriers, Andy explained, is the language requirement.
“That's a little bit difficult for Chinese doctors,” he said. “Also, maybe she is well-educated, and has a good educational background in China, but maybe Canada just can't accept it directly. So there are too many barriers.”
He said it could take several more years of studying and testing before Rui can even apply for a licence to practise medicine here.
“I know that if she has to pass the language test, then she may need to learn more than another two years. Then she could have the chance to challenge for the license of being a doctor,” he said.
Andy questioned whether more could be done to support skilled professionals who are already in Canadian communities.
“This moment could have ended very differently if my wife hadn’t been there,” he said. “And yet, in the current system, she still cannot legally treat patients in Canada.”

如果是下班off duty的醫療工作者,情況比較複雜。有的職業適用普通人情況,有的甚至必須救治。我小孩現在在做EMT訓練,他們的規定是,如果你穿著EMT衣服,或者別人知道你是EMT,比如你自報家門了,你就必須留下來治療,而且是嚴格條款。如果你不讓別人知道,你可以不救。
