28 weeks are less likely to survive. Maybe it's already dead in the birth canal.

28 Weeks is almost 7 months. The likelihood of surviving is pretty good though hospitalization is needed. Was the purpose to abort the baby or let it to be born early?
The doctor needs to be sued if the family wants to have the baby born early.

That's why in USA, to be a "fully independent" doctor, 4 years college + 4 years medical school, + 3-7 years residency!
In many countries, only 4 years college and some years residency!
