Assistant US Attorney David Kessler told the court that the parties had entered into a deferred prosecution agreement until December 1, 2022. If Meng complies with the provisions of the agreement, the US government will dismiss the charges against her on that date.
Meng pleaded not guilty to U.S. wire-fraud charges in a New York court proceeding Friday, just before prosecutors announced a deferred prosecution agreement reached with the U.S. Department of Justice, which was expected to allow Meng to be promptly returned to China.
Assistant U.S. Attorney David Kessler said that once everything is approved, Canada's attorney general would be notified that the U.S. is withdrawing its extradition request.
“ A deferred prosecution agreement (DPA), which is very similar to a non-prosecution agreement (NPA), is a voluntary alternative to adjudication in which a prosecutor agrees to grant amnesty in exchange for the defendant agreeing to fulfill certain requirements. A case of corporate fraud, for instance, might be settled by means of a deferred-prosecution agreement in which the defendant agrees to pay fines, implement corporate reforms, and fully cooperate with the investigation. Fulfillment of the specified requirements will then result in dismissal of the charges.”
