一個發明家的呼救

今天收到一個美國發明家組織的呼救郵件，控告蘋果手表侵權。我沒有看過該發明的具體內容，不做置評。

我有兩個身份，一個是專利代理（patent agent）。如果有普通律師資格，然後通過專利法考試，就叫專利律師。如果沒有律師資格但通過了專利法考試，就叫專利代理，可以在美國專利商標局代理客戶辦理專利申請審查複核等業務。我大約20年前考了專利法，列入了專利代理名錄，所以會收到一些這方麵的郵件，但我從來沒有給任何人做過代理。

我的第二個身份，也就是真實身份是獨立發明家，確切地說是愛迪生式的發明家，或者說是係統發明家。我也經常收到獨立發明家組織的郵件，但係統發明家又是獨立發明家中的另類。

獨立發明家是技術創新的重要源泉，大約75%的重大技術創新來源於獨立發明家。

專利法變異到目前的狀況，越來越繁複，越來越費用昂貴，越來越維護壟斷而偏離鼓勵創新的初衷。

Masimo was granted an ITC exclusion order on October 26, 2023, banning select Apple watches from being imported from China into the United States. The President has 60 days from the date of the exclusion order to allow or veto this order- December 25th.
