Fallen tree question for help

I bought a site that I plan to build a house next year. There's a tree fallen down a couple of month ago, damaged my neighbor's siding. This guy is a lawyer, kept asking us to pay for this damage. His reason is that there's ivy on this tree, thus it is considered as sick tree, and I am responsible for negelecting this sick tree.
