You can say the house is not closed yet and you are willing to walk away if for whatever reason it can't be closed on time. There are plenty houses available in the market place and you are not afraid of losing any one of them.

If he is to file anything with the court, he has to pay a fee. I don't think he will waste that money for he has nothing to gain.
