security deposit is different from holding deposit.

state law regulates security deposit as damages to the rental unit.  If the guy didn't move in, there is no damage to the rental unit, therefore in lots of states you have to return the security deposit. 

Holding deposit is used for damages caused by the tenant not showing up.  You can google holding deposit agreement, it's straightforward.
