Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.^[1]

譯文：國會不得製定有關下列事項的法律：確立一種宗教或禁止信教自由，剝奪言論自由或出版自由，或剝奪人民和平集會及向政府要求伸冤的權利。^[2]

 

就是說，憲法無權給予人們這些自由，因為這些權利是天賦人權，是天生的。不是人所可以給予的。憲法隻能保證我們無權剝奪人們的這些自由（信仰自由，言論自由，出版自由，集會自由，請願自由）。
