i agree with the "public" part, if the his school is a private one, but receiving federal funds, the school is still under constitutional and Title IX charge. i agree the "intentional" part is difficult to prove, but he needs to have evidence to prove the school is going different ways only because of the race when dealing with the same matter. race is a touchy issue, and it will be under "scrutiny test" in the court. if the case is in the court under 14th, the school need to prove such different treatment serves "compelling objective." of course, before that happens, he needs to find out evidence. without that, it would be waste of time and money.
