Of course he/she is the defendent

By law, the driver is liable for the damage. Insurance is "helping" driver by paying the cost. So of course the driver is the defedent. In this case, forward the notice to his/her own insurance company is fine. It's just a legal procedure. Do not contact the plaintiff's lawyer directly.
