求救：租房簽約後，發現信用很差，怎麽辦？

在SAN JOSE， 加州，最近買了個房子。5月23日，和一對印度夫妻簽約出租。6月6日搬進。他們交了$500押金。當時想，都是移民，應該會比較老實。

前天(6月1日)，我們做CREDIT CHECK，發現這個印度人信用極差。這兩年，開了十幾張信用卡，欠了銀行十幾萬，就不還銀行了。現都送到COLLECTION AGENT那裏去了。

我們當天就對他說，不租給他們，因為信用不好，同時，把$500支票郵寄到他家。今天，有個自稱是律師的人打電話來，說要我們下個星期法庭見。

我認為，有兩點，我可以悔約，請大家評論：

1。 合同是以夫妻倆人的名字申請的，但隻有丈夫簽字了。所以，我認為合同是無效的。

2。在合同中，有個條款：
15. PHYSICAL POSSESSION: If Owner is unable to deliver possession of the premises at the commencement hereof, Owner shall not be liable for any damage caused thereby, nor shall this agreement be void or voidable, but Tenant shall not liable for any rent until possession is delivered. Tenant may terminate this agreement if possession is not delivered within 14 days of the commencement of the term hereof.
我能不能說我親戚要來住(的確有個親戚6月16日來)，所以我是unable to deliver possession of the premises。從而達到悔約？
