The tax exemption from the treaty between U. S. and China is only applied to F1 and J1 holders on federal tax. Have not heard that H1B hoder could use that. State tax is different. Some states honor the treaty and some do not. Ask friends in the similar situation or internation program in the univerity near you to get answer.
