Help for Car accident!

I got a brand new BMW for about 40k last year. However, I was struck by a woman who was running through a red light and the police officer issued her a ticket at the scene. But my car was severely damaged. The lady has the same insurance company as mine and the insurance company decided it’s her fault. It cost the insurance company more than 10k+ to fix my car. After I get back the car, I don’t feel it was running as smoothly as before, now I want to sell it back to the dealer. However the price the dealer willing to offer is 8k less than the market value of the car. Can I claim this diminishing value from the insurance company? What documents/evidence do I need to present to the insurance company? Thanks!
