You got to have some evidence in order to win a law suit. Since you cannot prove it, hiring a lawyer really does not matter that much other than threatening them. I would suggest that you or your lawyer talk with them and possibly reach an agreement. Don't wait till too late. Once they fail your courses, they will get the excuses to terminate your employment based on "incapability".
