His roomate had a similar situation several years ago in TN. The police even pulled his gun when he was going to leave. He did not go to jail though because he explained to the police that he just misunderstood the police. I am not sure if this helps, but want to let you know there is possibility that the judge might believe your explanation. Get a good lawyer.
