As a matter of fact, my friend got an IRS inquery last year, so her tax refund was on hold for a few months, however, in the end IRS gave her the refund along with interest IRS owened her. IRS agreed that her tax return was done correctly including ACTC.

I agree that you should use form 8812 to calculate whether you can get a tax credit.
