Yours is EB

You are not his dependent! You got your GC through EB! You file your I485 with your hu*****and's I140, right? If that is the case, you got your GC through EB. (Although you got your green card because you married your hu*****and, but your GC catagory is not family based. Hopefully I am right.) Then you do not need your hu*****and to file it for you. When you filed your I485, you got your own case number, right? Now what you need to do is to file an I824 to ask USCIS to reopen your case, and add your child to that case. Hopefully I am right.

By that way, I assume your child was born before you got yours and was born through a marriage, right? Check all the conditions a Follow to join case has to satisfy. I think you can do that by yourself (without your hu*****and's help anymore).
