cheated by dealer, at dealership now, online waiting for help!!

We post the Penske honda sold us used Van as new one and need deal with them yesterday. We got lots of help here. Now we are at dealership and the dealer told us it is new Van. We showed them the carfax report. They said the DMV record was not updated. The former transaction was avoided. They said the former buyer signed contract but never drove the van out of the parking lot. So it is still defined as New. The define of NEW car is The car has to be sign to others and PHYSICAL DELIVERY TO BUYER. If the buyer signed contract but did not drive the car out of parking lot. It still count as NEW.

Is this true? anyone can help me find the law for defination of the NEW vs used car.
