If you loan the money to that guy without any benefit to you, such as charging an interest or something, courts will view the entire agreement unenforceable, because it is gratuitous and not supported by consideration. In another words, it is up to the court to enforce the agreement or not to enforce, although courts may enforce it based on unjust enrichment theories.
