1. No need to get a lawyer. No need even go to court. Pay the fine and go to traffic school to get rid of the points.

2. It does not matter who hit whom. You created that peril and you are responsible for it. Your insurance company will pay for the damage.

3. There are remote possibilities that you can reduce your liability, such as, that the other driver contributed to the negligence (driving over speed, etc.), or that you were acting in an emergency. Based on what you said those possibilities are nill.
