It doesn't matter what you know, it matters what the judge knows, and what judge can prove. 

If your husband doesn't like judge's ruling, he can appeal.  And on appeal, the appeal court will look at the record, and they'll overrule judge's ruling if there is no evidence to support it.  

The evidence, at mimum, would be actual name, address, statement, and swear to tell the truth.
