i think you are a f-1 student.

if so, your status has nothing to do with that bad guy. the international student office (not sure the name) of your school will help you apply for your opt or something else. remember, if you are the real victim of this case, you don't need to worry about anything regarding your graduation or visa status.
also, i agree with wal-mat, staying at USA is not that important.
