我們在加州，我已經提出離婚申請。由於對方一直evasive, 比如不接電話，不回email, 不開門，所以費了很多時間才serve到他。分居期間，他基本不主動邀請小孩回去，我或者小孩提出了，才會在周末去呆半天。

 

律師建議file a supplemental declaration seeking monetary sanctions against him, meaning we want him to pay more attorney's fees for his failure to cooperate.  The Court may or may not award us the fees, but at least the Court will be made aware of his bad behavior and perhaps it will persuade XXX to come to the table to negotiate.

 

我的想法是，我隻要child support和我的fair share，沒想過要多拿。他上班，供房子並不寬裕，我也理解。但是分居後（是我帶著小孩搬出去的）他一分child support也沒給過，的確也十分不負責任。但是我並沒有想把他逼急了，也不想他把錢花在這種地方。真有這些錢，還不如多出來分給孩子。

 

請教大家，這個有必要file嗎？謝謝。
