The best position to avoid the accident is not my logic. It is commonly used for assigning liability among parties involved.

For example: if you parked in a parking space without any violation, and when you backed out you hit a car that was illegally parked behind you. Who is responsible? You might be surprised when the judge tells you that you are partially liable because you are in the better position to avoid the accident as you are the moving vehicle and the other car is not. That is a real case.
