發廣告傳真要付$500罰款嗎？

急問，我自己有一個小公司在加州，通過發傳真打廣告，傳真號碼是從網上搜尋來
的。一家麻州的公司回信說這樣做違反聯邦通訊委員會的TCPA(Telephone Consumer
Protection Act)法案，要我直接付他$500， 否則告訴到法庭，那時有可能要加倍
付罰金。

我的問題是
1)我是否應付罰款
2)如果是，應否付給他個人，還是等法庭的消息
3)如果要出庭，我是否要去麻州？罰款是否包括對方的律師費和交通等其他費用？
