age discrimination？

LD 50 多了。 在一大公司多年了。  他說近兩年公司的小老板在他麵前說： "it is good to have a job at your age", 或者 “at your age, it doesn't matter if you do exercise or not", 或 在背後同其他同事講 “I think he is going to retire...".  有一次他火了， 就正式寫email 給其中一位說你必須 stop doing these. 公司上層也知道了此事，但大家都不願意出麵解決。我告他說你可以告公司 age discrimination, 但他覺得不願意就此跟公司對立， 也怕case not strong enough.  也沒主意了。 想聽聽這裏專家的意見。 謝了。
