老貓請進。warrant issue

美國紐約州給俺的朋友下了，criminal warrant 。
其實就是俺朋友的identity被別人盜用了等等事。charged with fraud。
俺問了律師
It is my experience that nothing can be done on your behalf until the warrant has been served.  If you have no intention of coming back to the US then it is likely that the warrant will never be served.  Please keep in mind that having an open warrant may affect international travel.  
我理解為如果沒有抓到俺朋友就沒有事情。如果不來美國就基本不會被抓到。

如果我朋友不服氣。是否可以請美國律師來打官司。我朋友不來美國。
如果要打官司，我朋友是否必須先到美國，get arrested first. 然後保釋等等，再在法庭打官司嗎？
