請教老貓, lexm5, 及諸位大俠：

前幾天出了件交通事故，具體情況如下：

我開車approaching一個十字路口，當時路口有警察在作traffic control， 路的另一邊有barricade to diverge the traffic.  我這一邊沒有控製.  There are cars in front of me and behind me, all driving as normal traffic.

當時我是綠燈，當我開進十字路口時（南行），一輛車從東邊越過警察開進路口（當時他是紅燈），和我車撞上。 因為警察當時就在現場，所以馬上給他開罰單，罰單是“fail to follow  traffic  control.”

我的車全部報廢，我的保險公司賠了錢，但扣下了deductible, 說等從對方保險公司拿到錢以後才退給我。  因為責任完全是在對方，對方應該全賠。

可今天我保險公司告訴我，對方上法庭說“traffic control set up wrong and the cop gave him sign to enter the cross section even though he knew he was on red light.  So he asked  the court dismiss the ticket”， 而法庭把確實 throw out the ticket.    所以對方保險公司說他們沒有責任，不負責賠償我的損失。

聽我保險公司口氣，好像就這樣完了。自己賠了我了事，當然我的deductible也拿不回來了。所以現在情況變成這樣了：
 

1．這事故變成我自己的 claim。 It will stay on my record and I am sure it will impact my premium next year. 
2．I lost my deductibles。 

我總覺著這事不對，現在我的問題是：

Traffic violation is one thing; causing damage is another thing. Even though he has no traffic violation but still caused my damage.  Can I sue him in smaller claim court to 1) get my deductible back, 2) let him pay the damage of increased premium for next year?
