Some states, includng AZ, have civil traffic offence/violations/ infractions.  

For your third paragraph, I see it differently:  those charged have to  retain either a PD or an attorney, otherwise they would not know how to move the court to dismiss a case like you do or to properly protect their interests. Making all traffic viloations as criminal will divert resources for city attorneys from prosecuting more serious violations like DUI.
