來美前３年免稅但在此其間交了140/485, 現被查，到底該不該免稅？

2005 10月來美H１B，2007 7月放水時交了140 and 485, 2008 8 NIW140批了，現４８５pending，持H１B。

現IRS調查我２００８的稅， 我當時申請了１０個月的免稅（10.2005-10.2008), 其中一問題是Did you ever apply for and/or have been granted lawful greencard in U.S.,   if yes, please give effective dates  of such application and/or status.

問題：
１， 關於IRS的question, 我應該如實寫我2007 7月交了140 and 485, 2008 8 NIW140批了，現４８５pending， 是嗎？

２， 我該不該免稅？是不是從我交的時間2007.7 (effective date should be 2007. 9)就開始不能免稅了？那我要返回給IRS的也太多了，我都拿不出這個錢來。
