OPT Grace Period

My OPT expires in May. The lawyer told me that even if I apply for the Oct 1 H1B, I will have to leave the country since the grace period is 2 months. However, I was under impression that as long las a new application is filed, the petitioner can legally stay.

Anybody familiar with this issue? Appreciate your comments.
