I read that memo. It is clear that you need to get the DOL once your LC be filed more than 365 days. That doc still be able to used when LC apporval and filed I140 and need to extended. Even the LC is a subsitution one.

The not clear thing is if your LC was apporval after 1 year, so meet the criteria that LC has pending more than 1 year, and now you get approval and you need to extended H1, whether you still be able to get doc from DOL .

Also there is a gap situation. That your LC get apporval within 1 year and you filed I140 less than 1 year, seem will be in trouble.
