Yes, you can claim treaty for the third year.
If you can file as resident, better compare both with or without treaty. If you total income is low, sometime can get more back without treaty. Read that tutorial carefully, everthing is in there.
If you take treaty, you will not qualify to take earned income credit (EIC).
