I am with H1B and my I485 is pending. I applyed H1B visa in Shenyang two months ago. I got checked but got the visa within 3 weeks. If you never have been out of legal status while you are in US, your visa application won't have much risk of being rejected.

If i were you, i would definitely go back home. Things will be fine and take care!
