Then what is his current status? If also H1 in a private business, he can transfer H1 immediately because not subject to additional quota.
If OPT(from gotten a master's or higher US degree), he can start now using OPT and apply for H1 later using the OAA new numbers for FY2005 with a start date between March 8 and Sept 30 of 2005. Don't need to wait till Oct 1 to start.
